隨著我國(guó)加入世貿(mào)組織，繼續(xù)擴(kuò)大改革開(kāi)放，需要對(duì)原有的外資三法利用外部程序進(jìn)行系統(tǒng)的整合升級(jí)。
With China's WTO entry and its efforts to expand the reform and opening-up, the three laws of foreign investment need to be integrated systematically using external procedures.

最大的區(qū)別還在于我們?cè)瓉?lái)做的是管理，現(xiàn)在我們主要是給它搞好服務(wù)，就是把外企當(dāng)做我們自己的企業(yè)來(lái)服務(wù)好，來(lái)發(fā)展好。
One of the biggest differences is that the priority of our work has transformed from regulation to service, which means the foreign companies will be treated as equals and we will create a better environment for their development in China.

我想在這部法律當(dāng)中，可能需要解決好這么幾個(gè)問(wèn)題：

第一，怎么讓外商到中國(guó)投資以后按照中國(guó)法律法規(guī)的要求，讓他的利益得到最大化；
The first is how to maximize the benefits to foreign businesses in accordance with China's laws and regulations after they invest in China.

第二，到了中國(guó)以后，外商的合法權(quán)益怎么樣能夠得到最有效的保護(hù)。
The second is how to effectively protect the legitimate interests of foreign businesses after they come to China.

這部法律我們俗稱(chēng)它是外商投資的促進(jìn)法和保護(hù)法。
The draft foreign investment law can be interpreted as the law for the promotion and protection of foreign investment.

所謂促進(jìn)即現(xiàn)在外商投資法的基本基調(diào)就是實(shí)行準(zhǔn)入前國(guó)民待遇加負(fù)面清單。比如，外商投資企業(yè)在許多領(lǐng)域準(zhǔn)入后，那么它和國(guó)內(nèi)的企業(yè)就是平等的，具有平等的機(jī)會(huì)。
Promotion means that the keynote of the law is the negative-list reform. For example, with the broadening of market access in many fields, foreign-funded enterprises will be treated as equals, which means they can share equal opportunities with domestic companies.

說(shuō)它是保護(hù)法，就是這部法律一改過(guò)去外資商法的許多不足。對(duì)外商投資的保護(hù)，設(shè)置了很多制度層面的規(guī)則。比如，它要求政府不光要信守合同，還要信守它的政策承諾。
Protection means the draft foreign investment law has corrected many deficiencies of the previous laws and it has set up lots of rules at the institutional level to protect foreign investment. For instance, the government is required to honor not only contracts but also policy commitments.

在中國(guó)從貨物貿(mào)易大國(guó)邁向世界貿(mào)易強(qiáng)國(guó)的過(guò)程中，這一部外商投資法的頒布實(shí)施，必定對(duì)全球投資貿(mào)易產(chǎn)生很大的促進(jìn)。
Currently, China is on its way from being a major trading nation in goods to becoming a world trade power. Therefore, the promulgation and implementation of the foreign investment law will certainly boost global investment and trade.

我覺(jué)得，一方面中國(guó)利用外資的這種能力范圍，特別是服務(wù)貿(mào)易領(lǐng)域的開(kāi)放程度會(huì)更加地拓寬。
On the one hand, China will further widen market access to foreign investment, especially to the service trade field.

另一方面，中國(guó)與全球各個(gè)國(guó)家之間的貿(mào)易范圍和領(lǐng)域也會(huì)更加拓寬，這也會(huì)為全球投資貿(mào)易帶來(lái)更多福音。
On the other hand, China will continue to strengthen its trade ties with foreign countries and expand trade scope, and that will bring more benefits to global investment and trade.
